By visiting the museum or purchasing an admission ticket you indicate your acceptance of the General Terms and Conditions of Museum Operations and the visitor regulations of KunstHausWien GmbH (hereinafter referred to as KUNST HAUS WIEN).
Scope of Application
The General Terms and Conditions of Museum Operations of KUNST HAUS WIEN (hereinafter referred to as the General Terms and Conditions) govern the legal relations between museum visitors, of the first part, and KUNST HAUS WIEN, of the second part. In the case of a transfer of an admission ticket to another person, it shall be incumbent upon the previous holder of the admission ticket, in each individual case, to point out to the next holder, respectively, that these General Terms and Conditions apply to such next holder. The General Terms and Conditions constitute an integral part of all contracts between museum visitors, of the first part, and KUNST HAUS WIEN, of the second part.Ticket Prices
The prices of KUNST HAUS WIEN as listed in the currently valid price lists shall apply. The prices indicated in the price lists are inclusive of the respective statutory turnover tax. KUNST HAUS WIEN reserves the right to set divergent prices in individual cases; such divergent prices shall be printed on the respective tickets.Reduced-price tickets may only be purchased by individuals who belong to the group of persons entitled to take advantage of the respective reduced price. Such groups of persons include school pupils, university students, seniors, handicapped persons, persons serving in the context of compulsory military service or alternative civilian service, unemployed persons, and groups comprising a minimum number of persons. There is no legal claim to a reduced-price ticket. Only one reduced-price ticket shall be sold to each individual per visit. Reduced-price tickets shall be invalid without the presentation of a photo-bearing identity card establishing the grounds for the price reduction. The so-called "international student identity card" shall not entitle its holder to a reduced-price ticket unless it is presented together with current proof of enrolment. In the case of improper procurement of such a ticket, KUNST HAUS WIEN shall be entitled to demand payment of the price difference or to require the visitor in question to leave the museum. In the latter case, the price of the ticket shall not be refunded, even in part.
Purchase of Tickets
KUNST HAUS WIEN always makes every effort to offer all interested individuals the best possible service with respect to the purchase of tickets. However, no individual shall have any legal claim to the purchase or reservation of one or more tickets for an exhibition or other event held by KUNST HAUS WIEN.Tickets for exhibitions at KUNST HAUS WIEN shall be available for purchase at the box office of KUNST HAUS WIEN during the respective opening hours. KUNST HAUS WIEN reserves the right to refuse to sell tickets to persons who disrupt the orderly sale of tickets, or who disturb other ticket purchasers or museum visitors, or who violate the house rules, or who refuse to follow the instructions of the box office personnel, for a specified period of time or, in serious cases, on a permanent basis.
On the first day of ticket sales for particularly popular exhibitions, KUNST HAUS WIEN reserves the right to limit the sale of tickets to two per person; KUNST HAUS WIEN may, however, make exceptions to this rule at its own discretion in individual cases. In general, tickets shall be paid for in cash, by debit card or by credit card. KUNST HAUS WIEN reserves the right to specify a minimum amount under which payment by credit card will not be accepted.
Return or Refunding of Tickets
A return or exchange of purchased tickets shall not be permitted. Tickets that have been lost, under any circumstances whatsoever, or only partially used, shall not be refunded; this applies in particular to late arrivals. The category of late arrivals shall also be deemed to include the case of persons arriving shortly before the closing of the museum, to whom admission cannot be granted due to the fact that an exhibition, or the entire museum, is already too crowded or overfilled, in particular in the event that certain areas of the museum have to be temporarily closed because they are too crowded or overfilled. Admission shall be guaranteed to persons who arrive no later than 90 minutes before the closing of the museum or the respective exhibition; if, in such a case, admission cannot be granted, the admission ticket shall be refunded.Cancellation or Change of Exhibitions, Guided Tours or Other Special Events
If an exhibition or another special event, the title of which is printed on the admission ticket, or which has been advertised in some other way, or to visit which, exclusively, admission tickets have been purchased, is replaced by another exhibition or event, or postponed, KUNST HAUS WIEN shall not take back already purchased and unused admission tickets for the respective exhibition or event. If an exhibition or other special event, the title of which is printed on the admission ticket, or which has been advertised in some other way, or to attend which, exclusively, admission tickets have been purchased, is cancelled completely, KUNST HAUS WIEN shall refund already purchased and unused admission tickets for the respective exhibition or event.Restricted viewing accessibility of the exhibition spaces due to temporary closing for special events or for conservation reasons in the case of persisting rainy weather or snow shall under no circumstances constitute grounds for a refund of admission tickets. KUNST HAUS WIEN expressly reserves the right to close any of its exhibition spaces due to weather conditions or special events.
Postponements or cancellations of guided tours or gratis events shall not entitle the ticket holder to a refund on purchased tickets. However, postponements of guided tours by more than two hours shall entitle the ticket holder to a refund of the tour fee. It shall be incumbent upon the visitor to telephone KUNST HAUS WIEN on the day of the respective guided tour or the respective event to find out whether any changes are being made.
Claims for Damages
Customers' claims for damages, based on any legal grounds whatsoever, including, but not limited to, the grounds of impossibility of performance, shall be excluded, with the exception of claims for damages on the grounds of wilful intent or gross negligence on the part of KUNST HAUS WIEN. This restriction shall not apply to compensation for personal injury, or for damage to property that has been given to KUNST HAUS WIEN for handling or processing, or for damage pursuant to the Product Liability Act (Produkthaftungsgesetz).Miscellaneous
The sale and offering for sale of admission tickets to KUNST HAUS WIEN by private persons is not permitted inside the museum. By entering the premises of KUNST HAUS WIEN, a visitor shall become subject to the house rules valid at the time. The visitor shall present a valid admission ticket to the museum personnel upon request. If a visitor violates the house rules of KUNST HAUS WIEN, KUNST HAUS WIEN shall be entitled to exclude said visitor from the exhibition and/or guided tour. In such a case, the price of admission shall not be refunded.Austrian law shall apply. For entrepreneurs and private consumers who neither have their (main) place of residence in Austria nor are employed in Austria, the court of competent jurisdiction in the third district of Vienna (1030 Vienna) shall have exclusive jurisdiction over any and all legal disputes arising from or in connection with this contract, including the conclusion or termination thereof.
KUNST HAUS WIEN reserves the right to amend and adapt the General Terms and Conditions as needed, in which case the respective amendment shall only apply to contracts concluded after such amendment has been made.
